An open complaint into Mike Kelloway - Conflict of Interest

In recent past, I have inquired into the hiring routines of Cape Breton Regional Municipality and Cape Breton Regional police. Over the coming weeks, I will be posting about the information I found, how the information was handled (or not) by CBRM, who I talked to throughout the process, and what their responses have been.


These posts will not be in chronological order.

Below is an open complaint into MP Mike Kelloway, and his conduct in relation to this situation. The complaint was sent this morning (2023-07-01). The last page has been removed so as to keep my contact info private.

Glad you brought out the family connections at CBRM.The CAO,POLICE CHIEF and PORT MANAGER{now retired} are all related.Also,ever notice how some faces at CBRM look familiar or the same last names pop up?I'll tell you why:NEPOTISM is rampant at the "rat's nest"called City Hall.The average Joe hasn't got a chance of getting hired unless they have a friend,relative,neighbour or some type of connection down there.There are areas there where they don't even want to hire so they can splurge on the overtime with the excuse they are shorthanded.Don't back down.

I hope that you are able to sort out your situation. It sounds like you have information around the scoring system that may show unfairness. If this is the case, the system should be changed. I am not a lawyer, but I don't see how MP Kelloway is in a conflict of interest. The relevant code states: "When performing parliamentary duties or functions, you are prohibited from acting in any way that would further your private interests or those of a member of your family,[i] or that would improperly further another person or entity’s private ​​interests.[ii] You are also prohibited from using your public office to influence a​ decision,[iii] and from using or communicating insider information[iv] t​o further your private interests or those of a family member or to improperly further another person or entity’s private interests. These are the circumstances that would result in an MP being in a conflict of interest, as defined in the code: an increase in, or the preservation of, the value of the person's assets; the extinguishment, or reduction in the amount, of the person's liabilities; the acquisition of a financial interest by the person; an increase in the person's income from employment, a contract, a business or a profession; the person becoming a director or officer in a corporation, association or trade union; or the person becoming a partner in a partnership.​ A private interest would not be considered to be furthered when the matter in question is of general application, affects the person as one of a broad class of the public, consists of being a party to a legal action relating to your actions as a Member of Parliament. I may be missing something, but it does not seem that you are accusing MP Kelloway of any of the actions above?

I couldn't care less how the government defines it.Common sense clearly indicates it is a conflict of interest.

The general expectation is that it would be in the *interest* of parties accused of an issue or wrongdoing to avoid accountability or disruptive changes. *If* there is biased hiring or manipulation of the candidate scoring process for new hires, that could potentially be a very damaging revelation. E.g. Island Employment. The complaint is suggestive that Kelloway might be reluctant to represent the citizen’s issue if it could adversely impact his brother-in-law, a relationship he apparently did not disclose to the citizen seeming his assistance(?). If he’s right about the accusations or inferences regarding hiring processes, it is something significant enough that it could cause disruption to management-level employees who oversee such practices. The first question is whether the situation described raises a valid ethical concern. As alleged, it does. The second question is whether the governing regulation under which he’s filing his complaint covers this specific scope. It certainly should, but may not. Clearly, a desired workplace outcome, even if not financial in nature, is “valuable” to (in the interest of) anyone. And, if a person with some level of authority, through actions or inaction, is able to permit or facilitate or in any way influence a family member’s preferred outcome, it would certainly be a conflict of interest, in the general definition of the term. A good lawyer would ensure it was argued within the scope of legislation. I’m more interested in whether the allegations are accurate. In the current environment, one would expect anyone that applied would be hired, as they tell the public they are struggling to recruit. But hiring people that scrutinize the details can be problematic. Union concerns approached with guerrilla tactics didn’t work out well for Lavin, although I’m still more interested in what he didn’t like than how he attempted to allege it (i.e. an email sent from a mock name, instead of just anonymous).

Folks gotta remember that there is another side to this story which we haven't heard.However there is clearly a conflict of interest no matter which way regular Joes or the suits look at it.Kelloway was in a position to make the complaint "go away" for his brother in law and if he had any doubt personally about a conflict it could have been resolved by first and foremost telling Tyler the truth about his relationship with the Chief and suggest he could arrange a meeting between him and fellow MP BATTISTE in hopes the situation could be settled.

For clarification, I am not stating that Mr. Kelloway recused himself from this issue because it would be a conflict for him, I'm stating that he reached out to me gathered a great deal of information KNOWING that he was in conflict. Before I ever spoke to Mr. Kelloway, I had spoken to his assistant and laid out the entire situation. Before even contacting me back, Mr. Kelloway was aware of the following: -He was aware that I had brought this issue up with Chief Walsh, CAO Walsh, Regional Solicitor Kachafanas, HR employee Deanna Best (now HR director......I'll speak about this in a separate article), and had gotten nowhere in the complaint process. -He was aware that I had a court case with CBRM over these hiring issues -He was aware that I was in possession of a cheat sheet that was given to *some* applicants -He was aware that there were complaints other than mine into the hiring process of police officers.....and CBRM denied these complaints even existed -He was aware that I had the master score sheet, interview booklets, cheat sheet, and he was aware that these documents all had very identifiable indicators that the hiring process was unfair to a lot of applicants Mr. Kelloway was VERY aware that his family members were involved in my issue, and he failed to recuse himself, he failed to declare that there is a conflict of interest, and he failed to refer me to another MP who would not be in conflict. I found out weeks later that Mr. Kelloway was related to the Chief and the CAO. This wasn't by accident.

I was pleasantly surprised to see this Post back on the Currently Trending list in goCapeBreton with almost 6000 readers.Tyler has awakened a sleeping giant out amongst the citizens of CBRM.This nonsense of non accountability gotta stop.I hope citizens contact their Councillor and also Municipality Minister Lohr and Premier Houston to tell them we had enough of the shameless day to day actions of our Senior Administrators and elected officials.Don't forget we pay these people with our tax dollars and don't let them tell you otherwise.They are supposed to act in our best interests and not their own.Thanks Tyler for having the guts to do what you did.
