The NSEF is providing the RCMP with our 25 plus years of data and evidence that the Nova Scotia Provincial Government is not following the constitution of Canada with regards to equalization. From time to time, we find some documents that you may not have seen and we are posting one of those documents here today. Thank you for following our efforts for equalization fairness. Here is the document:
Dear RCMP:
At this point in time, we are requesting the RCMP investigation approach the government federally to have the government legally provide the authority to transfer these huge sums of money unconditionally.
It should be perfectly clear that if this unconditional transfer is constitutionally provided for, the government is not doing anything wrong. However, in 25 years of the NSEF asking the federal government to provide this legal authority to transfer this funding unconditionally, the government has never answered this question. Why?
In the view of NSEF and our many followers, we feel as the national police force, the RCMP is responsible to uphold the laws of this country. It is incumbent upon the RCMP to approach government and seek the response from government, that it will provide no response to you and that should be one of the grounds for proceeding further legally.
We can provide many unanswered emails and letters to the RCMP proving that this important extra-legal practice by the government, is illegal and unconstitutional in nature. We have also asked many current and former Attorney Generals and Ministers of Justice this same question that they have all ignored. Why?
This investigation should also proceed to question the provincial government when it responds that “there is no connection between the provincial grant program and the federal equalization transfer”. This response by the provincial government is an admission that there are no plans to comply with the constitution and section 36 because the provincial program of $30 million each year can not address the federal funding provided each year for the municipal deficiency related to property taxes and misc. revenues. That funding this year alone is $565 million of the $2.458 billion provided. Basically, the province of Nova Scotia is using $30 million to address a problem that the Canadian taxpayers are providing $565 million for each year. It is easy to see how quickly this illegal activity is compounding for the residents outside of the capital region. High taxation, failing infrastructure, high unemployment, high poverty, failing municipal units and much more hardship is being bestowed upon all rural Nova Scotia because of an illegal activity by elected officials.
To pull this together…. over the years, governments without any scrutiny, have been manipulating this program without any conforming to the constitution or the ability of the citizens to hold them accountable. This kind of misappropriation of public money must be investigated by the RCMP. The significant issue is that historically this province has received approx. $50 billion of Canadian taxpayers’ money to assist the rural areas of Nova Scotia but there has been no accountability or transparency about how this important funding to the poorer areas of Nova Scotia, has been spent. The poorer areas of this province have not benefited from this funding. Why?
Why hasn’t the Federal Government stipulated that there must be separate accounting for this federal transfer? Nova Scotia’s own Auditor General has advised the province to do just that. The grandfather of Equalization, Dr. James Buchannan, has also told the federal government:
“The central government must, in effect, adopt a hands-on policy with respect to the ultimate distribution of the equalizing funds within the poorer regions.”
The RCMP must realize that when the Federal Government with its illegal, unconditional transfer is breaking its constitutional obligation and that sends a message to the provincial government that they do not have to comply with the constitution, and they basically admit this when they state there is no connection between the inadequate $30 million and the federal transfer of $2.458 billion.
We have much evidence of what we have stated above. We look forward to working through this process with the RCMP. The people of Rural Nova Scotia are depending upon the RCMP to end this injustice.
